Overview of case law: extent of the compensation owed by the diagnoser resulting from his erroneous report

Despite an attempt to bring the judicial and administrative courts closer together, the difference remains between the two levels of jurisdiction as to the extent of the reparable damage caused by the technical examiner who establishes an erroneous report. The evolution of case law shows a tendency to increase the responsibility of diagnosers in the event of an erroneous report, which should extend to the DPE for sales concluded after 2021.
